A Preemptive Strike at the ABA Over John RobertsJoseph Smith, chair of the ABA's Section on Litigation is hoping that the ABA will give Roberts a "well qualified" ranking, as it should, but Smith worries about the politicization of the process. He writes: "If history is any indication ... the ABA will struggle with the Roberts rating for a simple reason: He is conservative." Roberts will be a nice test of the ABA. And if they fail the test? According to Smith, "My membership expires on Aug. 31, and I don't plan to re-up until I see the ABA's rating of John Roberts."

A Tribute to Charles WhittakerGail Heriot offers a tribute to this mostly forgotten Supreme Court justice: "I love him for what he said on March 31, 1962, the day he resigned. Whittaker found the job exhausting, physically and emotionally. He said that he just wasn’t sure he had the talent necessary to do it well. He wanted to give somebody else a chance."
